GENERAL PROVISIONS
The controller of personal data collected through the website https://www.umbrellanetcon.pl/ is Umbrella NetCon Sp. z o.o. with its registered office at Aleja Ken 36/112 B, 02-797 Warsaw, entered in the entrepreneurs register under the tax identification number (NIP) 1251630710, email address: info “at” umbrellanetcon.pl, hereinafter referred to as the “Controller”, who is also the Service Provider. In case of any doubts or requests concerning the exercise of your rights, please contact our ABI/IOD at the above address. Your personal data is processed in accordance with the Act on the Protection of Personal Data of 29 August 1997 (Journal of Laws of 2016, item 922) and the Act on the Provision of Electronic Services of 18 July 2002 (Journal of Laws No. 144, item 1204, as amended). We also take action to achieve full compliance of our practices with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR). We take special care to protect the interests of persons whose data concerns, and in particular ensure that the data collected by the Controller is:
- processed lawfully,
- collected for specified, legitimate purposes and not further processed in a manner incompatible with those purposes,
- factually correct and adequate in relation to the purposes for which they are processed, and stored in a form which permits identification of the persons whose data concerns, for no longer than is necessary for the purposes of processing.
PURPOSE AND SCOPE OF DATA COLLECTION AND LEGAL BASIS FOR THESE ACTIONS
Your personal data is processed for two purposes:
- to respond to your inquiries sent via the contact form – the legal basis for these actions is the principle that processing is permitted if it is necessary for the performance of a contract or for taking steps at your request prior to entering into a contract,
- to send offers and other marketing and promotional content – the legal basis for these actions is your consent expressed under the contact form. We may process the following scope of your data:
- email address,
- phone number,
- any other data provided by you in the content of the inquiry sent via the contact form.
You are not profiled, which means that your data is not processed in an automated way to determine (estimate) your needs or personality traits. We do not collect additional information about you from other sources. We do not sell personal data, nor do we provide it to other entities. In particular, your data is not transferred outside the European Economic Area or to international organizations.
STORAGE AND DELETION OF DATA
We strive to limit the period of storage of personal data that is no longer in use to a maximum. However, we inform you that such a situation may occur for operational and technological reasons. By this, we mean the time needed to decide whether further contact is appropriate as well as the time needed to delete data from backup copies.
Your data processed for the purpose of handling a price inquiry will be processed by us for the duration of the correspondence, and then, depending on its results, will either be added to our customer database and further processed for the purpose of contract performance, or deleted if it is not possible to establish cooperation.
In the event of a clear termination of communication from your side, the data will be immediately deleted from the working system databases and from backup copies before 30 days have elapsed.
In the case of no response and unclear circumstances, the data will be stored for a period of 6 months from the date of the last message sent.
Data processed based on consent, therefore data used for sending marketing information, will be processed until consent is withdrawn. Please note that an additional period of 30 days is required to delete them from backup copies.
RIGHT TO WITHDRAW CONSENT, RIGHT TO CONTROL, ACCESS AND RECTIFY PERSONAL DATA, RIGHT TO DATA PORTABILITY, RIGHT TO OBJECT TO FURTHER PROCESSING, AND RIGHT TO LODGE A COMPLAINT WITH A SUPERVISORY AUTHORITY.
We hereby inform you that we process your data for marketing purposes based on your voluntary consent. We inform you that this consent may be withdrawn at any time. To do so, we suggest you send us a message from the same email address or phone number from which you receive marketing content. The sole consequence of withdrawing consent is that you will no longer receive information about our offers and other marketing content from us. We also inform you that withdrawing consent does not affect the legality of processing your data that occurred before such withdrawal. You have the right to access and rectify your personal data. If you find yourself in a particular situation where further processing of your data by us threatens your privacy, you may notify us of this fact and request us to cease or limit processing. You also have the right to request us to send your data to another entity in a form that the recipient will be able to process freely. We inform you that this right applies only to the data we received from you. Given that exclusive data about you is processed in textual form, transferring data will be reduced to generating text documents in docx format containing the history of your requests. These documents will not contain our responses, and therefore, in particular, our advice or other type of expert knowledge because it is not subject to your entitlement (it is not transferable). All of the above matters should be directed to our ABI/IOD at biuro@fotogorzow.pl. We inform you that you also have the right to lodge a complaint with a supervisory authority. Currently, this authority is the General Inspector for Personal Data Protection. National regulations, the implementation of which is enforced by changes in European law (GDPR), will define in detail who will be the legal successor of the GIODO. It will likely be the President of the Data Protection Authority, and the new office will be established on May 25, 2018.
